China CCER vs the Mandatory ETS: Where the Boundaries Sit

Sources checked

Foreign-invested companies and international teams working on carbon in China keep asking the same question: can a China CCER offset an ETS obligation? The answer depends on which obligation you mean and which use you have in mind — the Measures draw the line at project eligibility and at the permitted uses of a retired credit, not at a blanket yes or no.

Two separate markets, and where the dividing line is drawn

China runs two distinct systems. One is a national mandatory allowance-trading market; the other is the national voluntary emissions reduction (CCER) market, a separate national market whose trading product is the certified voluntary emission reduction (核证自愿减排量), issued in tCO₂e. The 2023 Measures do not characterise the mandatory market, so this article describes only the CCER side and its boundary rules.

The boundary is drawn by the Measures for the Administration of Voluntary Greenhouse Gas Emissions Reduction Trading (Trial), Order No. 31 of 2023 as amended on 20 September 2026. Article 10 states that projects covered by legal, regulatory or policy greenhouse-gas reduction obligations, or projects included in national and local allowance management, may not apply for CCER project registration. Compliance demand lives in the mandatory system; CCER sits on the other side of the line.

Which CCER use is actually allowed

The Measures do permit specific CCER applications. Article 28 provides that certified voluntary reductions used, in accordance with national provisions, to offset allowance surrender in the national and local carbon markets, to achieve carbon neutrality for large events, or to offset corporate greenhouse gas emissions must be retired in the registry. These are project-eligibility and credit-use rules at different stages, not one blanket answer: Article 10 excludes certain projects from registration, while Article 28 addresses the uses of credits that have been registered.

So the accurate framing is: CCERs may serve the listed uses, subject to national provisions and to registry retirement, and they are not the same instrument as allowances. Any statement that CCERs automatically substitute for a company's own mandatory allowance obligation should be checked against the current national provisions rather than assumed.

Two separate registration tracks

Project registration and credit registration are different steps with different conditions. Article 10 sets the conditions for applying for project registration, including that the project started construction after 8 November 2012. Article 17 sets separate conditions for applying for credit registration: credits must be measurable, traceable and verifiable, follow the conservative principle, match a published methodology, be generated after 22 September 2020, and fall within the methodology's stated registration time window. Article 17 does not govern project registration.

Cross-border: rules pending, not permission

For cross-border activity the answer is procedural, not permissive. Article 29 states that specific rules for cross-border trading and use of certified voluntary reductions will be formulated separately by the Ministry of Ecology and Environment together with relevant departments. That is a commitment to make rules. It is not a statement that free cross-border trading is allowed today.

Treat any offer to move CCERs across a border as something that needs a current rule citation, not a sales proposition.

An editorial checklist for your team

Framed as working guidance, not certified or legal advice:

  1. Identify which obligation actually applies to the entity, rather than assuming CCER or mandatory treatment.
  2. Check whether the project type already carries a mandatory greenhouse-gas reduction obligation or is under national or local allowance management; if so, it is ineligible for CCER project registration.
  3. Confirm which CCER use applies (allowance surrender offset, event neutrality, or corporate offsetting) and whether registry retirement is required.
  4. Keep the two registration checks separate: project registration conditions under Article 10, credit registration conditions under Article 17.
  5. For any cross-border element, demand the current rule text rather than relying on market commentary.
  6. Check the methodology's own registration time window and effective status against today, not against an issue date.
